The claim

Office impact is the term most likely to be faked. Writers give a 5 to whichever office they already like. The rubric is supposed to stop that. This essay would audit it.

Distinctions worth keeping

  • The office that writes the penalty.
  • The office that decides whether to use it.
  • The office that decides whether the constitution allows it.
  • The office that can only comment.

A governor who is eloquent about a felony he cannot rewrite does not get a 5. A judge who can suppress a warrantless file does.

To be written

  • Worked pairs: the same statute scored under two offices, with the sentences that justify each number.
  • What the score still misses in a separated judiciary: retention elections, appointment, and the fact that one judge is not a court.
